County setting parks legacy –April Huntley

I would like to inform the community that the Lowndes County Board of Commissioners has announced their “Consideration of Proposed List” for Special Purpose Local Option Sales Tax VII on July 22-23, 2013. It can be viewed on LowndesCounty.com.

The part of the budget that is most impressive to me is the allocation to Parks & Recreation. Its allocation is 3.5 million dollars. We need good recreation for our families in Lowndes County and to me this number sounds like our county commissioners take it serious.

I would also like to send out a big thank you to the commissioners for putting a Community Center in Naylor and a boat ramp on the Alapaha River as part of the purpose for the Parks and Recreation allocation.

Lowndes County needs public access to the beautiful Alapaha River as residents have enjoyed the river for generations. I hope the community will come together over this project and create a legacy for generations to come. Please send thank yous, ideas and comments to the commission about the Naylor project:

SPLOST VII county list @ LCC 2013-07-22

Not quite most of the money for roads, streets, and bridges (none of them named to the public), plus everything from animals to public safety, in the county’s SPLOST VII list. But don’t be alarmed: it contains no new library and no new auditorium, and the Chairman referred to it as a “back to basics” list. It also contains nothing about Internet access; more on that in a separate post. You can be told about this list tomorrow night or at a forthcoming joint county-cities public telling: no town hall meetings have yet been scheduled. 5. Special Presentation & Consideration — Special Purpose Local Option Sales Tax VII

There was something new in what Joe Pritchard said:

Commissioners each had an opportunity for independent review and evaluation.

That’s better than the county tradition of the staff write down the list and Commissioners rubber-stamp it. However, where are those town hall meetings Commissioner Joyce Evans promised? She reminded me afterwards that she had said “hopefully”. Mayor Gayle told me afterwards the problem was they were too close to the deadline for turning in the lists for the election. He indicated that was because the county was late. Remember Valdosta already presented its list 9 July 2013. Rumor has it the delay was in some Commissioners insisting on actually having input. That’s a good thing, but if the county planned ahead, there still would have been time for the rest of us to provide input before the lists were finalized.

Please deny the closure of County Road 16 leading to the Alapaha River —three neighbors

To the Lowndes County Commission:

It has been quite an experience dealing with the proposed closing of a portion of County Road 16. Our quaint spot on the river in Naylor, Lowndes County is something that can easily be taken for granted, but it is something that should be treasured and appreciated by the entire county. While we have learned a rich history about Naylor and the County Road proposed to be closed, we will not encumber you with these details. We will let you know in this letter the laws and reasons why the proposal should be denied.

First off, the landowner did not legally own the land when he made his request for the closing of the road. The legal date this property was deeded to Phillip Connell is February 8, 2013. The day his request was made is unknown because the letter sent had the date whited out and is an exact copy of the September 10, 2010 letter he submitted. It is known that the proposal for a public hearing was made in the Commission meeting January 22, 2013. The county should not be hearing this proposal for being misled by Phillip Connell. Why instead is the County claiming that a legal transaction for this land occurred 2 or 3 years ago and now has extended it to 3 or 4 years ago? Where is the proof for this claim?

Reconsider closing this road —James Manes

Regarding Regular session held Jan 22, 2013; Agenda 7 B, a request for road abandonment, I would like to state my opinion.

The road abandonment was to close a section of County Road 16 Old State Road. I feel this issue is not a open and shut case.

The county has determined “the road has been ceased to be used by the public”, and has no “substantial public purpose”.

I am aware the law (32-7-2 a) states “The department must confer with the governing authority of the county’s or municipalities (Unincorporated Naylor GA.), and give due consideration to their wishes in such abandonment.”

To the commission on the proposed idea of road abandonment on County Rd. #16:

On the morning of 2/25/13 after the county commission’s morning work session, my wife and I spoke with Joyce Evans and Bill Slaughter on some of our concerns and new found technical information about road abandonment, Georgia state waterways, and what the county and state are expected to protect.

During our conversation we were told that for unexplained legal reasons the county would have to give the road back to the land owner. At this time my thoughts and questions come back to: Why if for legal reasons do we have to give the land back or away, and why are we even having to have a public hearing on this matter, if the public has no say?

Georgia Recreational Use Statute

Suppose you owned land next to a river. You might have concerns about liability for people getting out of canoes or kayaks onto your land. But you’re in luck! Georgia state law says you’re not liable for most things that could happen.

The Georgia Recreational Use Statute is in O.C.G.A. §51-3-20 through §51-3-26. Here are a few excerpts.

§51-3-20. Purpose of article

The purpose of this article is to encourage owners of land to make land and water areas available to the public for recreational purposes by limiting the owners’ liability toward persons entering thereon for recreational purposes.

Dear Editor,

I’m not sure if people know or care that there is another Dollar General about to pop-up in Lowndes County. This time it will be in Naylor. I’m not sure if this will be an improvement or not.

Something I am also aware of and hold an opinion about is the proposal to abandon a road in Naylor that leads to the Alapaha River. This is the only public access to the Alapaha in Lowndes County. It is a place of history, recreation and fun for many people.

Thank you very much for helping the community get the public hearing for the closure of Old State Rd. tabled until next meeting! I hope we will all be able to work together to find a lasting solution that will enable the residents of Lowndes County and surrounding areas to continue to enjoy this beautiful spot on the Alapaha River. I hope you agree that this is not a standard road abandonment since it affects a body of water. I hope you have a great day, and I look forward to speaking with you soon!

Videos: Tabled Hotchkiss Landing Road Closing but Trash Co. Apology @ LCC 2013-02-12

Tabled! The applicant requested and the Commission unanimously voted to table the proposed closing of Old State Road to Hotchkiss Crossing on the Alapaha River until their next meeting, which is in two weeks, Tuesday 26 February 2013. A waste company executive suddenly rescheduled so he could come back and apologize to the public. All this and 3 rezonings and 3 contracts at the Lowndes County Commission Regular Session Tuesday 12 February 2013, plus people haven’t forgotten about animal shelter issues.

Video of Tabling of Abandonment of Old State Road to Hotchkiss Crossing at the Alapaha River @ LCC 2013-02-12

First the Chairman talked about how many people could speak and for how long in the public hearing; then at Tuesday evening's Regular Session the Commission tabled it for two weeks, so closing the only public access to the Alapaha River in Lowndes County will be up for a vote again Tuesday 26 February 2013.

6.a. Public Hearing: Abandonment of a portion of Old State Road (CR 16)

You can see in the video that the room was packed, which is very unusual. The great majority were there to oppose closing the road. As Chairman Bill Slaughter remarked, about nine people signed up for Citizens Wishing to Be Heard to speak about this item; as he noted, anyone can speak in a public hearing without signing up. To my knowledge, only one person was there to speak for closing the road, and that was the applicant who had just agreed to ask for it to be tabled. The Chairman said:
