Exclusive Franchise for Solid Waste Collection Services @ LCC 2012-12-11

Why did the Lowndes County Commission make this exclusive franchise with a Florida or Alabama or New York company and then sue a local Lowndes County company after the VDT reported the previous spring that any contract would be non-exclusive and wouldn’t put anybody out of business?

Here, obtained by LAKE through an open records request, is the contract with ADS of Middle Georgia, LLC. The the agenda item for the 11 December 2012 Commission meeting at which this contract was approved says ADS of Central Alabama, Inc. The contract says ADS is “a Florida corporation”, and we know ADS is owned by Highstar Capital of New York City. Once again, why is granting a cheap monopoly to an out-of-state company more important than either letting local companies compete for the service or having the county continue to provide a public service directly to its taxpayers and citizens?

More clues to how much garbage collection fees will go up

ADS proposed last December to Lincolnton, GA, to start trash collection with a rate very like what Veolia bid to Lowndes County, with increases every year after that.

The Lincolnton City Council heard a proposal to privatize the municipality’s trash collection service at its regular meeting held Monday, December 3. The presentation was made by Kevin Rupinta, general manager, and Steve Edwards, area municipal marketing manager, of Advanced Disposal, the Columbia County company that also serves Lincoln County.

The written proposal stated: “Since Advanced Disposal collects garbage in Lincoln County and runs through and around the City of Lincolnton, Advanced Disposal offers the following to reduce the city’s expenses:

(1) Purchase the city’s garbage trucks at an agreed upon fair market value.

(2) Purchase the city’s carts at an agreed upon fair market value.

(3) Provide garbage service for the city at rates that mirror those charged to the county.”

ADS buys At Your Disposal

ADS just bought a company called At Your Disposal, Inc. That’s interesting, because just six weeks ago State Sen. Tim Golden’s fraternity brother Steve Edwards, Atlanta Sales and Marketing for Advanced Disposal Systems (ADS), said he didn’t forsee any additional acquisitions. Additional after ADS’s purchase of Veolia six months ago, just after the Lowndes County Commission chose Veolia’s highest bid for waste collection, which was not as high as its soon-to-be-parent-company ADS’s bid for the same service package.

Trash lawsuit on WALB

WALB found the Lowndes County government sticking to the letter of its own recently-passed ordinance and contract, and Deep South Sanitation concerned about the county trying to put it out of business.

Lydia Jennings wrote for WALB yesterday, Lowndes Co. files lawsuit against solid waste company,

Lowndes County leaders are going to court to try to stop a sanitation company from picking up trash for some county residents.

County leaders say Deep South Sanitation is in violation of a new ordinance that only allows Advanced Disposal to contract with county residents.

And if the cease-and-desist order is successful, the owner of Deep South Sanitation worries he’ll go out of business.

Cary Scarborough owns Deep South Sanitation, a family owned and operated business he started in 2011 when he saw trash pickup problems in unincorporated Lowndes County.

In two years, he has seen his business grow with 800 Lowndes County resident contracts. But his days of picking up trash could be coming to an end.

“It could shut me down,” said Scarborough.

So why did the county give him a business license? And why is it a good use of taxpayer funds to sue him? The county’s answer:

Privatization: if it’s bad for Moody AFB, it’s bad for county trash collection

Why is Lowndes County Chairman Ashley Paulk decrying alleged privatization of Moody Air Force Base while promoting actual privatization of a basic Lowndes County public service, trash collection?

Jason Shaefer wrote for the VDT 5 December 2012, County disagrees with proposed zoning amendment,

Paulk alleged Moody’s intervention has prevented development before—the establishment of a small schoolhouse within a church near the base, for example, he said. He told the committee that Moody had 30,000 acres to the east on which to build, and that the air base has become “privatized.”

And yet at the upcoming commission meeting, Chairman Paulk will ask the commissioners to vote on this agenda item:

8.b. Exclusive Franchise Agreement for Residential Solid Waste Collection Services with Advanced Disposal Services of Central Alabama, Inc.

Seems to me that’s a privatization of one of our own county governmental services. Perhaps the commissioners will reconsider the “curbside only by a private firm” path they are on and conduct some public hearings in an effort to understand what the citizens might want in solid waste disposal.
