One Lowndes County Case, six Valdosta cases @ GLPC 2024-09-30

One of the two county cases from the lack-of-quorum GLPC cancellation last month is back on the agenda for tomorrow evening. The other former case was passed anyway by the Lowndes County Commission, without GLPC review.

The six Valdosta cases are new, and are all for small rezonings or the like.

Here is the agenda. Assuming the meeting actually happens despite hurricane damage.

Cancelled: Millage and Special Called Meetings because Hurricane Helene @ LCC 2024-09-26

A lowndescounty.com news item yesterday says:

Millage Public Hearing Meeting and Adoption Meeting / September 26, 2024 / CANCELLED

The Lowndes County Board of Commissioners is postponing the Millage Public Hearing scheduled for Thursday, September 26, 2024 at 5:00 p.m. as well as the Special Called Meeting for the Adoption of the Millage Rate which was scheduled for Thursday, September 26, 2024 at 5:30 p.m. due to Hurricane Helene.

These meetings will be rescheduled at a later date.

Also yesterday they posted that, “Lowndes County Offices will be closed Thursday, September 26, 2024, and Friday, September 27, 2024 due to Tropical Storm Helene.”

That all seems sensible.

And that cancellation announcement resolves the question we posed of how was the Commission to approve the budget, given there was no meeting scheduled for that?

I don’t see a Public Notice anywhere for that Special Called Meeting. Of course, state law merely requires the notice to be sent to the local legal organ of record (The Valdosta Daily Times). The law does not require that the notice actually get posted.

So apparently they cancelled a Special Called Meeting without the public having seen a notice that it had been called.

Final Millage Public Hearing and Vote to Approve @ LCC 2024-09-26

Update 2024-09-26: Cancelled: Millage and Special Called Meetings because Hurricane Helene @ LCC 2024-09-26.

5 PM, Thursday, September 26, will be the third and last public hearing opportunity for the millage rate. The first two were both on September 19, at 8:30 AM and 6:00 PM.

In the second hearing, Lowndes County Chairman Bill Slaughter said, “And then we will adopt the millage, setting the rate, on September 26, as well.”

How does that work? There is no Regular Session nor Special Called Meeting scheduled for September 26. Will they just vote after the Public Hearing, since presumably a quorum of Commissioners will be in the room? Or will they announce a Special Called Meeting, with at least 24 hours notice, as state law requires?

We don’t know, because no agenda is posted for this third meetings, just as no agenda was posted for the first two.

Work and Regular Sessions Cancelled @ LCC 2024-09-23-24

“The September 23, 2024 Work Session and the September 24, 2024 Regular Session Commission Meetings have been cancelled,” reads the Lowndes County response to the usual LAKE open records request for the board packet. No explanation was included.

The calendar entries on lowndescounty.com for the Work Session and the Regular Session are no more informative, merely saying &lquo;CANCELLED”.

However, the third and final Public Hearing on the Millage is 5 PM Thursday, September 26, 2024.

According to Lowndes County Chairman Bill Slaughter in the second Millage Public Hearing on September 19, “And then we will adopt the millage, setting the rate, on September 26, as well.”

How that will work is mysterious, since no agenda is posted for the Millage Public Hearing. Maybe they will just vote after the Public Hearing, since presumably a quorum of Commissioners will be in the room. Or they still have time to announce a Special Called Meeting at least 24 hours in advance, as state law requires.

This was the second public hearing opportunity, said Lowndes County Chairman Bill Slaughter, after the first one was 8:30 AM the same day. The third and last one will be on September 26.

He added, “And then we will adopt the millage, setting the rate, on September 26, as well.”

The only Lowndes County Commission meeting scheduled for September 26 is that Millage Rate Public Hearing. Does this mean they will vote in that meeting?

In this September 19 meeting, Finance Director Stephanie Black explained the millage, including state requirements for announcements of tax increases or rollbacks. She included the usual reminder that two Authorites get their own millage: Valdosta-Lowndes County Parks and Recreation Authority (VLPRA) and Lowndes County Development Authority (VLDA). FYI, the county Tax Digest is $5.1 billion.

Videos: Loch Laurel Road subdivision tabled; Pine Grove Road townhouses passed; TIA Orr Road Extension @ LCC Regular 2024-09-10

Update 2024-09-29: One Lowndes County Case, six Valdosta cases @ GLPC 2024-09-30.

They tabled the Loch Winn Farms subdivision until it could be heard by the Planning Commission.

But they passed the Pine Grove Road Townhouses, without any Planning Commission review.

I guess the Planning Commission doesn’t matter if it’s in the Lowndes County Commission’s preferred development corridor in what staff call Central Lowndes County. Also, nobody spoke against, and Jack Langdale spoke for.

Commissioner Demarcus Marshall asked for a timeline for 6.a. Orr Road Extension, P.I. 0016273 TIA Project Agreement. Answer from County Engineering Services Director Chad McLeod: late 2025 bid process.

One citizen spoke: William Cary, about plastic recycling, saying Waste Management will no longer pick up plastic.

The Lowndes County Commissioners spent quite a while discussing whether they would table 5.a. REZ-2024-15 Loch Winn Farms, LTD, ~62ac, R-A to R-1 – R-A, indicating they probably would, but informing the public was difficult, because the actual decision would be made at the Regular Session the next day.

They did not have as much discussion about tabling for 5.b. REZ-2024-16 Pine Grove Road Townhouses, 6.3ac, C-H to P-D, which may well be a signal that they won’t table.

Both rezoning cases were not heard by the Planning Commission due to a lack of quorum.

We will see how irrelevant the Planning Commission is.

The preceding GLPC meeting was cancelled due to lack of a quorum, yet the two county rezonings are on this Lowndes County Commission agenda for a decision this week. If the County Commission decides without hearing from the Planning Commission, that will be quite interesting.

Since both rezonings get Public Hearings, you can stand up and speak during those, without waiting for the Citizens Wishing to Be Heard ghetto at the end of the meeting.

Also on the agenda is Orr Road Extension, P.I. 0016273 – Transportation Improvement Act (TIA) Project Agreement, for $1,175,000. That’s in addition to the previous TIA projecta:

  • $2,400,000 Clyattstone and Simpson Road Grading, Drainage, Base, and Paving
  • $3,750,000 Hightower Road and Cooper Road NE Paving Project

Which totals to $7,325,000 in TIA money for just these three road projects. Sure, that’s state money, but it’s still your tax dollars.

Citizen Burton Fletcher spoke for five minutes about Animal Control Funding, out of the fourteen minutes of the Regular Session of the Lowndes County Commission of August 27, 2024. That leaves 9 minutes, minus 2 minutes for the County Manager Report and a minute for the Call to Order, Invocation, and Pledge, means 7 minutes of actual business. They approved everything unanimously.

They reappointed Bill Booth and appointed Debra Ruth to the Lowndes County Library Board.

Nobody spoke for or against the 6.a. Basic Decorative Street Lighting Districts.

County Manager Paige Dukes in her Reports said staff were attending the statewide Homebuilders Association meeting. Homebuilders are “stakeholders” after all.

In Citizens Wishing to Be Heard, Burton Fletcher noted $1.5 million for the Animal Shelter didn’t actually help much, and he wondered what has happened in the year or two since groundbreaking.

Four minutes is all yesterday morning’s meeting took, the Work Session of the Lowndes County Commission.

Vice Chair Demarcus Marshall chaired the meeting in the absence of Chairman Slaughter.

The only questions were about 7.b. Annual Contract Renewal with the State of GA Department of Corrections. Public Works Director Robin Cumbus explained that the county only pays when the work details are used and that no qualified inmates have been available for some time, however having the contract in place makes it possible to use the inmates, should any become qualified.

The County Manager’s Report may or may not have been requested. In any case, she didn’t report. She usually saves that for the Regular Session.
